Terms & Conditions (T&C) for the web site www.beautykosm.ch as of 1 January 2015
1 . Purpose and Application of Terms.
These Terms and Conditions (hereinafter referred Conditions) regulate the relationship between Alema Professional GmbH (hereinafter Alema Pro) owner and manager on the web site www.beautykosm.ch (hereinafter referred the web site) and the Customer (hereinafter Customer) that is purchasing products on the web site. These Terms and Conditions are part of any other contract that might exists between Alema Pro and the customer.
2 . Offer.
The prices mentioned in our offers as well as order confirmations are still valid and, subject to errors and technical changes. The promotional prices are always refered to Alema Pro suggested retail price list.
3 . Delivery and shipping.
Items available from stock are usually delivered as fast as possible. In any case, delays in delivery do not justify damages and / or a right of termination requests. The risk passes to the buyer once the shipment has been delivered to the person/courier who transports. All the products ordered will be delivered with postage fees to the address specified by the customer. Delivery is only possible in Switzerland. Unless otherwise specified by the customer when ordering Alema Pro reserves the right at its discretion to full or partial deliveries.
4 . Price / Payment options and delay in payment / Ownership.
Our prices are net prices in CHF, and if not otherwise specified are inclusive of VAT. Purchases of goods are to be paid by invoice and / or credit card such as: Visa, MasterCard or American Express or other financial services such as PostFinance or PayPal. Alema Pro reserves the right to exclude certain types of payment or to request of payment in advance. When paying by invoice, customer agrees to pay the bill without discount within 30 days of the date of receipt of the goods. In case of return shipment, the invoice amount may be reduced accordingly. If customer falls behind his/her payments, Alema Pro reserve the right to charge late payment fees. The delivered goods remain property of Alema Pro until full payment. Subject to errors and technical changes or tariff. Legal recourse is excluded.
5. Exchange.
The items can be exchanged within 7 days after receiving goods. An exchange is only possible if the goods and the original packaging are in good condition, that the packaging has not been opened and the goods have not been used. To make an exchange the customer must first receive an authorization number (RMA number) from Alema Pro. The exchange takes place as fast as possible only after the customer send back the goods to Alema Pro and Alema Pro receive them. The exchange is performed only with other products available on the site and to a maximum of value of the returned goods. Any shipping costs incurred by the customer to send back the goods will not be refunded. Products that needs to be changed can be sent to Alema Pro headquarter to the attention of RMA Department to the following address:

6 . Warranty.
Alema Pro only sell new products as they leave the factory with the quality of the manufacturer. Items used are specifically marked and identified as such. Alema Pro makes no warranties and assumes no liability as to the ability of these goods to meet the objectives set by the customer or for their functionality. To this end, the right to claim the customer is limited to the extent suggested by the manufacturer's warranty. Unless otherwise stated, Alema Pro offer for all new products, a minimum guarantee of 14 days starting from the date of purchase. During the warranty period, Alema Pro reserves the right, for items that are no longer available, to provide a replacement item which technically has the same value or give a credit note taking account of depreciation the product on the market in time to meet the warranty claim. The decision on replacement of a product remains with Alema Pro. Regarding any changes in products, the warranty period always refers to the date of original purchase. Any other provision of the guarantee contained in the package, for example, is valid in the country of manufacture. It is not possible to enforce these provisions of the warranty and are considered void. Alema Pro disclaims any liability for direct or indirect damages as well as any financial loss due to a defect or improper handling of the product. 7 . Claims for defects.
In case of technical problem customer should always first read if available the instructions for use in paper or electronic form. Alema Pro customer support can be contacted at the following telephone number: +41 (0)44 545 75 00 or via email to: beautykosm@alemapro.ch. Claim for defects must be made in writing within 7 days from the date of receiving the product. In case of defect during the warranty period , the customer must return the product with the original payment receipt and a clear description of the fault upon discovery to the Alema Pro RMA department. When sending, the product must reach Alema Pro in its original packaging or in suitable packaging. The following items are generally not included: Products that were not purchased from Alema Pro, Used products, Unpacked items.
8 . Jurisdiction.
All parties are subject to Swiss law. In case of disputes with consumers, the forum is the place of residence or registered office of one of the parties when the action is brought by the client, when the action is brought by Alema Pro the forum is the one of Alema Pro.
